Jan Andersson, a Swedish
socialist MEP, who is the chair of the European Parliament's
Social Committee, spearheaded a motion to challenge the effect
of the recent ECJ cases. The motion - largely intact in spite
of numerous amendments being put forward - has now been adopted
by the Parliament on the 22 October 2008.
This requires the European
Commission to act to allow "the exercise of fundamental
rights as recognised in the Member States, in ILO Conventions
and in the Charter of Fundamental Rights of the European Union,
including the right to negotiate, conclude and enforce collective
agreements and the right to take industrial action..."
We've still got a long
way to go before the effect of the ECJ cases is reversed and
the fight over the balance of rights between business and
workers in the EU is going to be very significant for us and
our children. Workers throughout Europe have to be united
and make themselves heard.
